Obligations That Come With Operating a Fuel Site
The operating entity must appear correctly on facility and storage tank registration, carry evidence of financial responsibility for tank liability, maintain release detection and inspection records, keep dispensing devices registered and accurate under weights-and-measures rules, hold fuel tax licensing, and maintain the retail licenses for alcohol, tobacco, lottery, and food service.
Recordkeeping is a legal obligation in itself. Missing release detection records is a violation independent of whether a release occurred.
The Lease Clauses That Decide Your Risk
Four clauses matter more than the rent. First, environmental responsibility — who owns pre-existing contamination and who pays for new releases. Second, tank and equipment ownership and upgrade obligations. Third, indemnification, running both directions, and the insurance required to back it. Fourth, surrender condition at the end of the term, including whether you can be required to remove tanks.

Getting It Reviewed Properly
Have petroleum-experienced counsel review the lease, the fuel supply agreement, and any image or franchise obligations together — they interact. A supply term longer than the lease term, or a remodel obligation without a matching renewal option, is a trap that only shows up when you read all three documents side by side.
