Florida's storage tank program governs registration, secondary containment, release detection, spill and overfill prevention, testing and inspection intervals, reporting of suspected and confirmed releases, financial responsibility, and closure. Both owner and operator can hold obligations. Regulators pursue whoever is registered and whoever is operating, regardless of private lease allocations — the lease then determines who reimburses whom.
Fuel Quality, Measurement, and Taxation
Retail dispensing devices must be registered and accurate, fuel must meet state quality standards and be labeled correctly, and price posting rules apply. Motor fuel taxes require licensing and periodic reporting, and the operating entity is responsible for collection and remittance.
Payment device security and skimmer inspection requirements also apply at the dispenser and are inspected in the field.
Retail Licensing and Local Approvals
Alcohol and tobacco licensing, lottery retailer approval, food service permitting where prepared food is sold, sales tax registration, and local business tax and certificate of occupancy requirements in the City of Tallahassee or Leon County all attach to the operator, not the landlord.
