Environmental review is the step that decides whether a service station purchase closes on time, closes with a price adjustment, or does not close. In Palm Beach County, shallow groundwater and wellfield protection zones raise the stakes.
This is the environmental due diligence sequence for buying a service station.
Step One: Records Before Drilling
Pull the FDEP storage tank facility record and discharge history, county Environmental Resources Management files, prior assessment and remediation reports, tank and piping construction and installation dates, release detection and inspection records, and compliance inspection results.
Check whether the site or an adjacent parcel sits inside a wellfield protection zone and whether any nearby property has an open petroleum case whose plume could migrate.
Step Two: Phase I and, Usually, Phase II
The Phase I ESA follows ASTM E1527-21 and supports the All Appropriate Inquiries defense. On an active fuel site it almost always identifies recognized environmental conditions, which leads to a Phase II with soil borings, monitoring wells, and laboratory analysis.

Step Three: Allocate the Risk in Writing
Negotiate who pays for identified contamination, whether a portion of price is escrowed, whether the seller retains responsibility for pre-closing discharges, and whether state cleanup program eligibility exists. Consider pollution legal liability insurance as a bridge.
